Hi,
I am Indian national on H1B, waiting on priority date to be current to file for I-485. My wife is currently working on TN visa. Will there be any issue with her being on TN status when I file for adjustment of status (for me and for her together). What options I can consider in advance so that I-485 process will not halt with last minute surprises.

You can't.. It's very risky and not worth the trouble.. I tried and got denied.
Is more than 6 yrs of IT experience from a non-computers engg background good for applying for EB2 position? Can you comment from your experience.

Hi Gurus,
My wife has her H4 Visa stamp until 1st Oct 2010. She is in India. I am planning to visit India and travel back with her. If my visa gets stuck in "Admin Processing" will my wife be able to travel back on her valid H4 Visa.
She has to travel back due to some personal reasons.
Please advise.

Bill Gates wrote in the Washington Post several years back that there is an employment gap that H-1B visas help fill:
This issue has reached a crisis point. Computer science employment is growing by nearly 100,000 jobs annually. But at the same time studies show that there is a dramatic decline in the number of students graduating with computer science degrees.
The United States provides 65,000 temporary H-1B visas each year to make up this shortfall -- not nearly enough to fill open technical positions.
H-1B workers, who have united under grassroots groups like Immigration Voice , want more than just an increase in visas. They want the government to streamline the rules.
Currently, the workers have to apply for green cards through their employers, often a lengthy and cumbersome process. They can't switch jobs easily and sometimes have to reapply for a visa even if they move jobs within the same company. They have to leave the country every few years before they can reapply for a visa.
The workers can also apply for a spouse to come to the U.S., but their partners are not allowed to work under the H-4 status granted to them. The activists argue that those individuals represent a skilled base of workers who could contribute to the U.S. economy and help pay for household expenses.

H1 Transfer and Extention

I am working in US from Feb 2007 to till date. I was on H1-B visa This H1-B petition is valid till 30 sep,2009. I am currently on project which ends on 31 March 2009 . Before that I want to change my employer .
Some ppl suggested me Transfer H1 with extention immediately. Some said that stay with current employer have extention and then transfer . Is there any problem now a days for H1 Transfers ?
Please give me your valuable suggestions.

With not many 'easy' H1b cases anymore. This looks like another route for the 'attorney' to get more clients, selling fear!
I agree !! it is definitely bad news and many may end up spending more on a plastic card. more business for lawyers !!!
maybe guiness book of world records should have an entry for the costliest plastic card I just hope and pray that future generations have better options at home and in different countries and links such as these point out the hard truth that everyone needs to have a plan B - and be mobile and ready to move. (i.e. not get stuck with immovable assets).

My 485 (based on NIW) is pending. Based on the current bulletin, it could take years to approve my case. I currently work in the US using H1 visa. But I may need to travel outside the US for 1 year or even longer for business reason. Is there any way that I can not abadon my 485 pending status? Thanks!
You must change your AOS to CP. That way if your I485 is adjudicate while you are out of US, you could get the GC from the elected US consulate/embassy.

2) If so when do I have to leave company A or is there any way I can continue with Company A and get my GC processed through company B.

This is a notice on the identification of foreign countries whose nationals are eligible to participate in the H-2A and the H-2B nonimmigrant worker programs. The notice becomes effective when it is published in the Federal Register on 1/18/11.

Yes, I am also seriously finding out the solution for this. One of my friend told me that I can wait until I receive the finger prints. Once finger prints received then we should not get finger prints done. That way, USCIS terminates our applications. Not sure, how easy it is.

I am looking to switch employers. Although the job descriptions are pretty similar ( C coding, design, protocols etc.), my PERM was filed for Computer Software Engineer-Applications whereas the new one falls under Computer Software Engineer, Systems Software. Is this a risk during I-485 adjudication. Also my new salary is 50% higher than my original PERM salary (It has been almost 4 years since my original PERM).
