yes. look up the archives, this has come up quite a few times. Some people say going from EAD to H1 is a one-way street and coming back requires new H1 subject to cap. Many others (including my attorney) say that you can come back on new H1 (or even existing H1 petition if its not expired) without being subject to quota/cap. Reactivating the H1 does require a trip out and back into the US.

Hi Sri,
Don't panic. This is NOT the end of your immigration journey. You are covered by AC-21, so if you find a job in a similar occupation with another employer, you can certainly take it. Your employer should seriously consider appealing the denial in order to preserve its reputation and to continue to employ H-1 workers.
If you have reason to believe that your employer might not be fully compliant with immigration laws, particularly as they relate to labor certifications and I-140's, you would be most protected if you changed employers

I am planning to get my H1 stamped during my next trip to India and have a couple of questions
1) Have anyone used Yourmaninindia or Sahara Care or any other service to deposit H1 forms at VFS Mumbai. For Mumbai consulate, the forms need to be submitted 3 days prior to Visa Interview and they do not accept courier :mad:
2) I recently found that if you have an appointment at one of the consulates in Mexico, you can Fax the 797 and get PMIS verified in advance.
Do we need to submit the entire H1 fee for appointment ? If there is a cheaper way, I am thinking of taking an appointment , get PMIS verified and cancel the appointment.
3) Any idea if they do a PMIS verification for H1 extensions (same company) as well ?

Any suggestion whether to switch attorney after using AC21 and moving to new company?
If you have good relationship/communication with your previous attorney, it is not recomended to change, as it is a additional work for uscis, that they may not like it. The new G-28 may not properly attached, uscis may not update the information ect may cuase you unrest. As long as possible, avoid contact with uscis, unless they asked to do as they are heavily backlogged with all application.

Sorry folks, the question may have been asked before.
Does I-140 have to be approved before using AC21? In my case, I140 has been pending for 1 year now, but got EAD recently.

I am currently using EAD. My I-485 is pending status. I am planning to get married in India soon. She will be in India as I can not bring her on H4 and student visa is difficult. So dilemma is about 485 name addition. Can I add spouse's name in I-485 application whenever Priority Date is current?
If yes, then how does it work? I mean is it possible at all?
As long as you get married before your I-485 is approved, you can file a 'follow-to-join' petition for your spouse when your priority date becomes current. You will need to submit I-824 when your PD becomes current. Your spouse will obtain an immigrant visa overseas after the petition is approved.
You may contact an immigration attorney if you cannot file this on your own and require help.

I dont know of anything specific.But if it's a job designation of utmost importance at the state level then it might help in name check(I am not sure) but otherwise I dont think it makes any difference.

Hi,
I have applied for I-140,I-485 and I-765 on 16th of Aug'07,dint get the receipt yet. I would be leaving to India this month and would return only in Feb'08.
My major concerns are:
1. once I get the notice for FingerPrints, can I reschedule it to Feb'08.

I am not sure that you would be allowed to do finger printing at American consulate in India.

Is it right?I am working on EAD, if it doesnt come in time any ideas about the FAX # which you need to send your request? I have already opened an expedite request for my EAD by calling USCIS customer service, I just need the fax # and the cover letter format. I heard that even if you take an info pass appointment, they dont issue an interim EAD , is that correct?

I am asking this question for relative of mine. I wanted to get some honest opinions.
My relative was manager in India for family company (extended family) for 3-4 years. He received visitor visa about 2 years ago, and subsequently arrived in US.
After taking extended tour of US, he felt that he could expand Indian company's business in US. His companied in India tried to open up business in US. He received L1A for 1 year. However, due to bad economy, business advantature wasn't successful.
He wanted to try to stay in US and try some other management position for established company. Subsequently applied for H1B. He recently received denial notice from USCIS.
Currently, original L1A is expired. L1A extension is pending (lawyer was late in filing, and only filed 7 days before expiration of original L1A).
Is he out of status at this point (expired L1A and denied H1B)? L1A extension is still pending.
What are his option if he wants to stay LEGALLY in US?
Please excuse my ignorance but I do not know much about immigrations, as I am US Citizen myself and never had to go through this grusome process.
I would also appreciate attorney's input.

On a less positive note, further delays in the EB1 and EB2 categories for Indian nationals is expected as well as the EB3 category for all nationalities. With the Department of Labor's optimistic projection that the the Backlog Elimination Centers will meet their goal of eliminating its backlog and processing the remaining labor certifications filed pre-PERM implementation by September 2007, the DOS expects severe retrogression in many of the categories, particularly the EB3 categories - across the board. While this report is pure speculation, it does spark concern that applicants will be facing further delays in the permanent residence process. The DOS' Visa Bulletin is released on a monthly basis at http://travel.state.gov/visa/frvi/b...letin_1770.html. Greenberg Traurig will continue to monitor this issue and provide further updates as soon as they are available.
Looks like it's a long haul for EB3 in general and could be punishing for EB3-IND and EB2-IND.
This is the effect of increasing the H1B quota to 115,000 for 2 years and then to 195000 in 1 year without actually increasing the GC quota.
Good luck to all of us. Those who are in late 2001 and early 2002 EB3-IND filers can hope to get relief in the next year or so but unless some bill passes other EB3-IND filers should possibly work towards Plan B. Also read the report by USCIS ombudsman. It's quite revealing about the working of USCIS. This country might be technologically advanced but it's bureaucracy seems to be much worse than third world countries comparitively.

I don't understand whats problem with fragomen - they will do everything in paper - never e-file a thing. I see lot of people e-filed their I-140 and already got notice date (second day of efile)!
Mine is in EB2 case and I had sent all documents (VOEs, Letters from HR of prev employers, W2 and usual) while labor was being filed itself.

I understand that a H1B visa is the expense to the employer and is not a taxable benefit to the employee. If a company wishes to pay for the green card for the employee, granting them permanent residence in the U.S., is this a taxable benefit to the employee? Should it be added to their W-2? If yes, where is the IRS documentation on this? I can�t find it. Thanks.
If the company pays for GC expenses directly, then it is an expense to the company, and it will not be reported on W2 as it is not a taxable benefit. However, if you are being reimbursed for GC expenses, *some* companies report this in paycheck as non-taxable income, again you will not be paying taxes to IRS on this. It is just a record keeping.
